Ukraine New Technical Regulation on Radio Electronic Devices (RED) & Frequency Registration

Since April 1, 2018, UA RED TR came into force according to the Decision of the Cabinet of Ministers of Ukraine No. 355 dated 24 of May, 2017.

The Ukrainian Technical Regulations for radio devices are equivalent to the Directive 2014/53/EU of the European Parliament and European Council dated 16 of April, 2014.

Previously issued certificates will be valid until April 1, 2019. Certificates which are subject to extension in the period from April 1st, 2018 to April 1st, 2019 and further will be prepared under the new regulations. The transition from the previous regulation to the new one will take place over one year, from April 1st, 2018 to April 1st, 2019.

New labeling Requirements are on the side:

For a conformity assessment procedure according to the module H (compliance based on the full quality assurance), such as NCB028 & NCB 052, and national conformity mark (UA TR mark) along with identification number (UA.TR.YYY) from the responsible conformity assessment body is required.

For a conformity assessment procedure according to module B (type examination), such as NCB 001 & NCB 032, only national conformity mark (UA TR mark) is required.

According to Article 26 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine”, the State Regulation of Communication and Information (NCCIR) regulates the use of radio equipment, including in connection with software, which can affect compliance with significant requirements.

Manufacturers must submit a registration application to the National Commission for the NCCIR by providing the information on the types of radio equipment having a low level of compliance with the essential requirements. This information must contain pieces of technical documentation. The NCCIR will then provide a manufacturer with a registration number for each type of such equipment.

This number must be applied to the radio equipment put on the market from June 12, 2018.

Criteria to set up registration, types of equipment and information to be registered, and operational rules for registration and labeling are subject to the NCCIR decision.
